Vitable Targets ACA Compliance Risks for Hourly Employers

PHILADELPHIA, PA — Vitable Health has launched a managed compliance service aimed at helping employers with hourly and variable-hour workforces meet Affordable Care Act requirements, targeting a market where tracking employee eligibility and avoiding federal penalties remains a significant operational challenge.

The new service, called ACA Autopilot, is designed for employers subject to the ACA’s Employer Mandate, which generally requires businesses with 50 or more full-time equivalent employees to offer qualifying health insurance coverage or face potential Internal Revenue Service penalties.

Industries with large hourly workforces, including home care, food service, retail and construction, often face added compliance complexity because employee schedules fluctuate and eligibility must be tracked continuously throughout the year.

The service automates eligibility monitoring, calculates employee status under IRS measurement rules and generates coverage offers when workers become eligible.

A second tier includes audit representation, assistance responding to IRS penalty notices and support during compliance reviews.

The launch reflects growing demand for outsourced compliance services as employers contend with increasingly complex reporting requirements and labor-intensive workforce tracking obligations.

“Eighty million Americans work hourly jobs, most of them for small employers who are one IRS audit letter away from a six-figure penalty they didn’t see coming,” said Joseph Kitonga, founder and chief executive officer of Vitable Health.

Kitonga argued that many employers struggle with ACA compliance because the regulatory framework requires continuous monitoring of workforce hours, eligibility determinations and annual reporting.

Unlike some compliance vendors that focus primarily on identifying eligible employees, Vitable said its platform also automates the process of extending coverage offers through the same system employers use to administer benefits.

The company already provides IRS form preparation and filing services for employers using its benefits platform. ACA Autopilot expands that offering by adding year-round compliance monitoring and audit support.

The launch comes as employers continue balancing healthcare costs, workforce retention efforts and regulatory compliance requirements in sectors that rely heavily on hourly labor.
