DRESHER, PA — The family of a man who died after developing Guillain-Barré Syndrome following a seasonal influenza vaccination has received a $373,371.11 settlement through the federal vaccine injury compensation system, according to law firm My Vaccine Lawyer.
The settlement was awarded through the National Vaccine Injury Compensation Program, a federal no-fault program that compensates individuals and families for certain vaccine-related injuries and deaths when eligibility requirements are met.
According to information released by the firm, the man developed ascending paresthesias and progressive weakness less than a month after receiving a flu vaccine. He was subsequently hospitalized, diagnosed with Guillain-Barré Syndrome, and treated with intravenous immunoglobulin therapy.
Guillain-Barré Syndrome is a rare neurological disorder in which the body’s immune system attacks peripheral nerves, potentially causing muscle weakness, paralysis, and respiratory complications.
The firm reported that the man’s condition deteriorated after he developed pneumonia during his hospitalization. He later died from severe respiratory distress.
The settlement includes compensation for pain and suffering, lost earnings, and medical expenses incurred before his death.
Attorney Leigh Finfer represented the family in the claim.
The National Vaccine Injury Compensation Program was established by Congress in 1986 and is funded through an excise tax on covered vaccines. Claims are adjudicated in the U.S. Court of Federal Claims and do not require proof of negligence by vaccine manufacturers or healthcare providers.
A compensation award through the program does not constitute a determination that a vaccine was defective. Rather, the system is designed to provide compensation in cases where covered injuries are found to meet statutory and medical causation standards.
My Vaccine Lawyer, based in Dresher, represents clients nationwide in vaccine injury claims and other litigation matters. The firm stated that it regularly handles cases involving Guillain-Barré Syndrome, Shoulder Injury Related to Vaccine Administration, transverse myelitis, and other injuries recognized under the federal compensation program.
