Pennsylvania Secures $200 Million in Long-Running JUA Legal Battle

HARRISBURG, PA — The Commonwealth of Pennsylvania has received $200 million following the conclusion of a years-long legal dispute between the Office of Attorney General and the Pennsylvania Professional Liability Joint Underwriting Association (JUA).

The transfer follows a federal court ruling that sided with the Attorney General’s position that the JUA, created by the General Assembly in 1975 to insure high-risk medical providers, is a public entity. The dispute began after the legislature passed Act 44 of 2017, ordering the $200 million transfer to the state’s general fund. The JUA challenged the law, prompting litigation that spanned multiple years.
