WILMINGTON, DE — A 64-year-old Wilmington man faces felony and misdemeanor charges after New Castle County Police allege he fired a shotgun in the Graylyn Crest community and damaged a camera belonging to Delaware State Police.
Police identified the defendant as Kevin Smith, 64.
At approximately 5:10 p.m. Aug. 15, officers responded to the Graylyn Crest community for a report of a man walking along the roadway and firing a shotgun, according to police.
Before arriving, officers received a description of the individual and subsequently located Smith sitting on a swing in the front yard of a residence in the 1800 block of Graywell Road. He was unarmed at the time and was taken into custody without further incident, police reported.
Investigators allege Smith had located a camera attached to a sign in the area and fired a shotgun at it, damaging the device. Police later determined that the camera belonged to Delaware State Police.
Authorities further allege Smith recklessly discharged the shotgun within the residential neighborhood, creating a risk to nearby occupied homes and residents.
During the investigation, officers recovered a shotgun and shotgun ammunition from inside Smith’s residence, according to police.
Smith was charged with two felony counts of first-degree reckless endangering, misdemeanor criminal mischief under $5,000, misdemeanor possession of a firearm while under the influence, and misdemeanor discharging a firearm in an area of an occupied dwelling.
He was arraigned at Justice of the Peace Court 11 and released on $3,500 unsecured bail.
All suspects, arrestees, and defendants are presumed innocent until proven guilty in a court of law.
