Pennsylvania Judiciary Committee Approves Bill to Support Military Families

HARRISBURG, PAHouse Bill 491, introduced by State Representative Chris Pielli (D-Chester), has cleared a significant hurdle with unanimous approval from the Pennsylvania House Judiciary Committee. The legislation aims to establish concurrent federal and state jurisdiction over military installations in the Commonwealth, a move designed to address the unique needs of military families, especially children, within the justice system.

Currently, exclusive federal jurisdiction on military bases can subject military-connected juveniles to a federal justice system that lacks the rehabilitative resources available in state courts. Rep. Pielli emphasized the importance of this change, explaining, “When military installations are under exclusive federal jurisdiction, military children who find themselves in trouble are often forced through a federal justice system that does not offer as many rehabilitative options as does our Commonwealth.” He added that the bill would allow for state involvement in cases where local resources may better address juvenile mental health and related issues.

H.B. 491, which amends Title 42 of the Pennsylvania Consolidated Statutes, seeks to create a pathway for military installations to collaborate with state and local officials through formal agreements. These partnerships would clarify roles and responsibilities, ensuring that juvenile misconduct cases involving military-connected children are handled with an emphasis on rehabilitation rather than punitive measures.

The legislation has drawn widespread bipartisan support, as evidenced by the 28-0 committee vote. It also carries the endorsement of the Department of Defense. Pielli underscored its importance, stating, “Military families often face challenges that state resources and state courts may be better suited to address, including their mental health.”
