HARRISBURG, PA — A Wyoming County doctor was sentenced Monday to 14 to 48 months in state prison for prescribing Schedule II controlled substances without adequately assessing patient risks or documenting medical justification, conduct Pennsylvania prosecutors said endangered patients.
Dr. Raphael Benjamin Kon, 62, of Noxen, received the sentence after pleading guilty in August to unlawful administration, dispensing, delivery, gift or prescription of a Schedule II controlled substance, according to the Pennsylvania Attorney General’s Office.
The investigation found Kon continuously prescribed controlled substances without assessing whether the heightened risks of abuse, diversion or overdose outweighed any medical benefit, prosecutors said.
His patient medical files also lacked documentation supporting the prescriptions, and Kon failed to monitor how patients responded to the medications, according to the Attorney General’s Office.
“Patients trust their doctors to protect their health and safety, and this defendant broke that trust by recklessly prescribing potent medications,” Attorney General Dave Sunday said. “This type of behavior by a medical professional contributes to an addiction epidemic that already impacts every Pennsylvania community.”
The prosecution followed a presentment by the 52nd Statewide Investigating Grand Jury.
Kon closed his medical office and surrendered his Drug Enforcement Administration license after authorities executed a search warrant at the office in 2024, according to the Attorney General’s Office.
Deputy Attorney General Christy Schlottman prosecuted the case.
