HARRISBURG, PA — Pennsylvania Attorney General Dave Sunday said his office has reached a $1 million settlement with a southeastern Pennsylvania dental practice accused of misleading patients about Medicare coverage and steering consumers into financing arrangements that left many with significant debt.
The settlement with Infinity Dental, which operates as Alpha Dental Excellence, resolves allegations that the company sold costly dental procedures to elderly and low-income patients by falsely suggesting the services would be covered by Medicare, according to the Attorney General’s Office.
Traditional Medicare generally does not cover routine dental services.
The agreement requires Alpha Dental to provide approximately $517,000 in restitution to affected consumers, pay $232,983 in civil penalties, and reimburse $250,000 in investigative costs. The defendants will make monthly payments until the $1 million obligation is satisfied.
The settlement, filed in Bucks County Court of Common Pleas, remains subject to court approval.
State investigators launched the probe after receiving multiple consumer complaints regarding Alpha Dental’s sales and financing practices.
According to the Attorney General’s Office, the investigation found the company used aggressive marketing tactics, including hosting free dinner events aimed at attracting elderly consumers. Patients were allegedly encouraged to purchase expensive dental services based on representations that Medicare would cover the costs.
Investigators alleged that Alpha Dental either failed to submit claims to Medicare or submitted claims that were denied because the procedures were not eligible for reimbursement.
The state also alleged that patients who could not immediately pay for treatment were pressured into obtaining third-party financing. Investigators found that the company routinely failed to provide disclosures and cancellation rights required under Pennsylvania’s Credit Services Act.
According to the Attorney General’s Office, some financing applications were submitted without patients’ knowledge or consent, while other applications allegedly contained falsified information. The investigation also uncovered allegations that the company imposed unlawful cancellation fees.
“The patients who were misled and deceived by Alpha Dental often ended up with large loans and bills they could not afford,” Sunday said. “Alpha Dental was fully aware that Medicare does not cover dental procedures and concealed that information while convincing patients to purchase costly procedures and services.”
Under the settlement, Alpha Dental and related parties are prohibited from making deceptive statements regarding insurance coverage, reimbursement, financing options, payment arrangements, or consumer billing practices.
The agreement also bars the company from misrepresenting its participation in Medicare or private insurance programs, advertising services as covered when they are not eligible for reimbursement, and providing assistance to consumers in obtaining credit beyond informing them that third-party financing may be available.
