Guatemalan National Indicted for Alleged Illegal Reentry into the United States

HARRISBURG, PA — Cesar A. Reyes-Garcia, a 43-year-old Guatemalan national, has been indicted by a federal grand jury on charges of illegal reentry into the United States by a previously deported alien.

The indictment, announced by United States Attorney Gerard M. Karam, alleges that Reyes-Garcia was previously removed from the United States on June 11, 2015, through Harlingen, Texas. It is alleged that he was subsequently found in the United States without having first obtained legal permission to reenter the country. The indictment further alleges that on January 16, 2023, Reyes-Garcia was encountered in Lebanon County, Pennsylvania.

The case was investigated by U.S. Immigration and Customs Enforcement and Removal Operations. Assistant United States Attorney Stephen Dukes is prosecuting the case.

If found guilty, Reyes-Garcia could face a maximum penalty under federal law of two years imprisonment, a term of supervised release following imprisonment, and a fine. Any sentence following a finding of guilt will be imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

As with all indictments, the charges against Reyes-Garcia are only allegations. All persons charged are presumed innocent until proven guilty in a court of law. Further updates on this case will be provided as they become available.
