WILMINGTON, DE — A 24-year-old man is facing felony assault and firearm charges after Wilmington police identified him as the suspect in a shooting that left a 39-year-old man critically wounded earlier this month.
Officers responded at approximately 9:18 p.m. Sept. 1 to the 800 block of West Seventh Street for a reported shooting, according to police.
Police said officers found a 39-year-old man suffering from a gunshot wound. The victim was transported to a hospital in critical condition.
The case was assigned to Detective Johnnie Everett of the Criminal Investigations Division. During the investigation, Everett identified Brian Mcelwee, 24, as the suspect in the shooting, according to police.
On Sept. 22, officers spotted Mcelwee in the 800 block of North Adams Street and attempted to make contact with him, police said. Police allege Mcelwee fled on foot before officers took him into custody a short time later without further incident.
Officers also confirmed that Mcelwee had an outstanding warrant from Pennsylvania, according to police.
Mcelwee was charged with first-degree assault, possession of a firearm during the commission of a felony, possession of a firearm or ammunition by a person prohibited, and possession of a deadly weapon by a person prohibited.
Police said Mcelwee was arraigned in New Castle County Court of Common Pleas and committed to the Howard R. Young Correctional Institution on $97,500 cash-only bail.
All suspects, arrestees, and defendants are presumed innocent until proven guilty in a court of law.
