WILMINGTON, DE — A 14-year-old boy faces felony firearm charges after New Castle County Police allege officers recovered a loaded 9mm handgun during a foot patrol in the Edgemoor Gardens community.
At approximately 2:43 p.m. Aug. 11, officers assigned to Patrol C-Squad were conducting foot patrols near Rysing Drive when they observed several individuals walking in the roadway, according to police.
Officers stopped the group at Rysing Drive and South Cannon Drive and identified them as two 14-year-old boys and a 16-year-old boy, police reported.
During the investigation, officers developed probable cause and allegedly recovered a loaded 9mm handgun from inside the pants of one of the 14-year-olds, according to police.
That juvenile was taken into custody and charged with felony possession of a firearm by a person under 21, felony carrying a concealed deadly weapon and misdemeanor resisting arrest. He was arraigned by Justice of the Peace Court 11 and committed to a juvenile detention center after failing to post $21,002 cash bail, police reported.
During the same investigation, officers determined that the second 14-year-old was allegedly violating a court-ordered curfew stemming from a previous incident, according to police.
The second juvenile was charged with misdemeanor breach of release. He was arraigned by Justice of the Peace Court 11 and released to a parent on his own recognizance.
The 16-year-old was released without being charged with a criminal offense, police reported.
All suspects, arrestees, and defendants are presumed innocent until proven guilty in a court of law.
