IRS Extends Deadline for Clean Vehicle Sellers to Submit Time-of-Sale Reports

The Internal Revenue Service (IRS) recently announced an extension for dealers and sellers of clean vehicles to submit their time-of-sale reports following the launch of a new online portal aimed at aiding the industry. The move is part of the tax agency’s continued efforts to support the growth of the clean vehicle market and streamline reporting processes.

The new IRS Energy Credits Online (IRS ECO) portal, which became operational on January 1, 2024, allows dealers and sellers to report sales of clean vehicles. Typically, these reports must be submitted within a three-day window as per Revenue Procedure 2023-38. However, with the introduction of the new system, the IRS is temporarily extending this period through January 16, providing additional time for both dealers and the IRS to adapt to the new reporting tool.

Consequently, dealers and sellers now have until January 19 to submit a time-of-sale report for vehicles sold between January 1 through January 16. This extension provides a brief reprieve for those still familiarizing themselves with the new system or experiencing technical difficulties.

While the IRS is fine-tuning the new system, dealers and sellers are encouraged to continue submitting their time-of-sale reports using IRS ECO. However, the agency urges sellers to use this extension period only if they are unable to successfully submit a time-of-sale report immediately after a sale. This is particularly important when the vehicle is for a customer who intends to claim the tax credit on their tax return.

The IRS has pledged its commitment to resolving any issues that manufacturers, dealers, and sellers may encounter when navigating the new IRS ECO tool. To further assist users, the IRS will host office hours during which representatives will be available to answer questions and provide guidance on time-of-sale reporting.
