FTC’s 2023 Ethanol Market Concentration Report Affirms Sufficient Competition

The Federal Trade Commission (FTC) has recently published its 2023 Report on Ethanol Market Concentration, as directed by the Energy Policy Act of 2005. The Act mandates the Commission to carry out an annual review of market concentration in the ethanol production industry to ascertain whether there is adequate competition among industry participants to prevent price-setting and other anti-competitive behavior.

Echoing the findings of previous years, the 2023 report concludes that the level of concentration and the large number of market participants in the U.S. ethanol production industry continue to suggest that the exercise of market power to set prices or coordinate on price or output levels is unlikely on a nationwide basis.

The report was approved by the Commission with a unanimous vote of 3-0, reinforcing the FTC’s commitment to maintaining fair competition and preventing monopolistic practices in the country’s vital energy sectors. This report is part of the FTC’s ongoing efforts to monitor and regulate industries to ensure a competitive business environment for all market participants.
