East Brandywine Weighs New Restrictions on Residential Decks

East Brandywine Township

EAST BRANDYWINE TWP, PA — East Brandywine Township supervisors will consider new restrictions on structures within required rear yards in age-qualified residential communities on November 5, alongside a separate ordinance correcting the township’s zoning map.

The proposed zoning amendment would prohibit buildings, uncovered platforms, steps, terraces, and decks within required rear yards in age-qualified residential communities, limiting where certain structures could be placed on affected properties.

Supervisors will hold public hearings on both ordinances at 9 a.m. at the East Brandywine Township Building, 1214 Horseshoe Pike, Downingtown. The board could vote to enact either measure during its regularly scheduled meeting that morning.

The residential restriction would amend Section 399-75 of the township’s zoning code, which regulates projections into required yards. The ordinance specifically addresses age-qualified residential communities rather than residential properties throughout the township.

The second proposal would replace East Brandywine’s existing zoning map to correct its measurement scale.

According to the township’s legal notice, the replacement map is intended to correct the scale on the current document. The notice does not identify any proposed changes to zoning district boundaries or land-use classifications.

Both ordinances are authorized under the Pennsylvania Municipalities Planning Code and would take effect immediately if enacted.

The November 5 hearings will provide residents and property owners an opportunity to ask questions and comment before supervisors consider final adoption.

Complete copies of the proposed ordinances are available for public inspection at the township administrative offices, 1214 Horseshoe Pike, Downingtown, from 9 a.m. to 4:30 p.m., Monday through Friday, excluding legal holidays.

Copies may also be obtained for a fee not exceeding the cost of reproduction.
