HARRISBURG, PA — Former Somerset County District Attorney Jeffrey Lynn Thomas has lost his final bid to challenge his 2023 conviction, after the Pennsylvania Supreme Court declined to review his case. The decision leaves intact a ruling by the state Superior Court, which previously affirmed that Thomas received a fair trial and that the jury’s verdict was supported by the evidence.
Thomas, 40, was convicted of six charges — including indecent assault and strangulation — stemming from a violent incident inside a Windber home. According to investigators with the Office of Attorney General, Thomas entered the victim’s residence, refused to leave, and proceeded to beat and sexually assault her.
He was sentenced to 2½ to 7 years in state prison and is currently serving his term at SCI Waymart. After release, he must register as a sex offender for 15 years.
Attorney General Dave Sunday said the Supreme Court’s refusal to take the case affirms the strength of the prosecution and the fairness of the proceedings. “We are pleased that the defendant’s latest attempt to evade accountability for this attack has failed,” Sunday said. He added that courts consistently agreed the trial process was proper and that the jury weighed overwhelming evidence.
Senior Deputy Attorney General Tracy Piatkowski represented the Commonwealth on appeal, while Chief Deputy Attorney General Patrick Schulte and Senior Deputy Attorney General Tomm Mutschler prosecuted the case. Thomas later pleaded no contest in a separate domestic abuse case in Cambria County.
