Honduran Man Pleads Guilty to Firearm Charge After ICE Arrest Finds Loaded Gun

PHILADELPHIA, PA — A Honduran national residing unlawfully in Philadelphia pleaded guilty this week to possessing a firearm as a convicted felon, United States Attorney David Metcalf announced.

Marvin Enrique Pena-Portillo, 38, entered his guilty plea on Monday, July 14, before United States District Judge Mitchell S. Goldberg. He was arrested in April and formally charged in June.

According to court records and statements, on April 15, 2025, agents from Immigration and Customs Enforcement (ICE) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) apprehended Pena-Portillo for immigration violations. During the arrest, officers found a loaded 9mm semiautomatic pistol concealed in his waistband.

In August 2024, Pena-Portillo had previously pleaded guilty in the Philadelphia Court of Common Pleas to illegally carrying a firearm in public and received a two-year probation sentence.

Sentencing for Pena-Portillo is scheduled for October 22.

The case was investigated by ICE Enforcement and Removal Operations and the ATF and is being prosecuted by Assistant United States Attorney Robert Eckert.
