Pennsylvania AG Sues Contractor for Alleged Fraud, Consumer Violations

HARRISBURG, PA — Attorney General Dave Sunday has filed a lawsuit against Brian Myers and his business, Harpen Construction, LLC, accusing the Pittsburgh-area contractor of violating the Pennsylvania Home Improvement Consumer Protection Act (HICPA) and the Unfair Trade Practices and Consumer Protection Law.

The lawsuit follows complaints from consumers who allege that Myers and Harpen Construction collected large sums of money in advance for home improvement projects but failed to deliver the work as promised. Since 2021, the Office of Attorney General has received ten complaints describing situations where consumers paid thousands of dollars to the company for projects such as kitchen, bathroom, or bedroom remodeling. Many claim the work was never completed, and in some cases, the work performed was minimal at best.

One consumer reported paying nearly $60,000 upfront, covering 90 percent of the project cost. Despite the substantial payment, work began 18 months after signing the contract and was later abandoned, leaving the property uninhabitable.

The lawsuit also alleges that some contracts used by Harpen Construction failed to comply with HICPA requirements, missing critical information such as registration numbers, start and stop dates, insurance details, and the three-day right of rescission notice that protects consumers.

“This is the time of year when scammers target homeowners looking to make improvements, so Pennsylvanians should have their guard up,” said Attorney General Sunday. “This company blatantly broke the law by not making good on paid-for contracts, and for using contracts that did not comply with Pennsylvania’s Home Improvement Consumer Protection Act.”

Harpen Construction is no longer registered under HICPA. The attorney general’s lawsuit seeks to bar Myers and his business from further operating as home improvement contractors in Pennsylvania. It also demands consumer restitution, civil penalties, and legal costs.

Consumers who believe they or someone they know may be a victim of Harpen Construction, LLC, or Brian Myers should file a complaint with the Bureau of Consumer Protection online, call 1-800-441-2555, or email scams@attorneygeneral.gov. Inspectors, contractors, laborers, suppliers, or anyone with information about Harpen Construction, LLC, or Brian Myers are also encouraged to contact the Bureau.
