Arrest Made Following Shoplifting, Lewdness Incident at Bear Lowe’s

BEAR, DE — The Delaware State Police recently apprehended Dane Smith, a 30-year-old Ocean View resident. Smith was charged with shoplifting, lewdness, as well as other criminal offenses following a disturbing incident that took place earlier this week in Bear.

According to the criminal complaint filed, on May 2, 2023, at approximately 4:06 p.m., troopers were dispatched to the Lowe’s store on 1030 East Songsmith Drive where they discovered Smith passed out on the floor after intentionally inhaling several cans of air duster that he had not paid for. Additionally, the suspect also exposed himself and vomited on himself in front of other shoppers, creating a public disturbance.

Upon arrival, a trooper attempted to take him into custody but Smith allegedly resisted arrest and engaged the trooper in a physical struggle before being eventually subdued with the aid of a Taser and put under arrest.

Smith was taken to an area hospital for medical treatment. Afterward, he was taken to Troop 2 and charged with the following crimes:

  • Resisting Arrest With Force or Violence (Felony)
  • Offensive Touching of a Law Enforcement Officer
  • Shoplifting Under $1,500
  • Lewdness
  • Menacing
  • Inhaling Intoxicating Fumes or Vapors
  • Disorderly Conduct

Smith was arraigned by Justice of the Peace Court 2 and subsequently sent to Howard R. Young Correctional Institution, having been unable to post the required $6,000 secured bond.
