ERIE, PA — Mark Daniel Fenstermaker, a 39-year-old former resident of Oil City, Pennsylvania, has been sentenced to 96 months in prison following his conviction of Hobbs Act robbery and violation of federal firearms laws. The sentencing was handed down by Senior United States District Judge David S. Cercone on Tuesday, November 14, 2023.
Fenstermaker pleaded guilty to the charges and admitted to his role in a robbery that took place at Spanky’s Tobacco World in Venango County, Pennsylvania on October 14, 2021. During the course of the robbery, Fenstermaker used or brandished a firearm, which further escalated the severity of his crimes.
The successful prosecution of Fenstermaker is part of Project Safe Neighborhoods (PSN), a nationwide initiative aimed at reducing violent crime and gun violence. Launched on May 26, 2021, PSN espouses core principles such as fostering trust and legitimacy within communities, supporting community-based organizations that help prevent violence, setting focused and strategic enforcement priorities, and measuring results.
Assistant United States Attorney Paul S. Sellers prosecuted the case on behalf of the government. The investigation leading to Fenstermaker’s successful prosecution was a collaborative effort involving the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Pennsylvania State Police, the Oil City Police Department, and the Venango County District Attorney’s Office.
United States Attorney Olshan commended all the law enforcement agencies involved in the investigation, highlighting their tireless work in ensuring the successful prosecution of Fenstermaker.
